“DOWNTOWN MIXED USE DISTRICT” Analysis For Zoning Change.

 

This proposal must be evaluated by the State Land Planning Agency of Florida in Tallahassee.

The authorities in Doral are analyzing a modification to the  “Downtown Mixed Use” District, this with the objective to provide more flexibility to combine the use of commercial areas and to promote an efficient urban development for the area under the category of “Downtown Mixed Use (DMU)” District.
The Director of Planning and Zoning of the City of Doral, Mr. Julian Perez informed us about this, he explained that what these proposed changes try is to adapt to the actual needs of our city and create incentives so these parcels can be develop  in a more productive and convenient way for everyone.

Perez is speaking specifically about the parcels located South of NW 58th street, East of NW 87th avenue, North of NW 33rd street and West of 79th avenue. “What we are analyzing is to amend the Comprehensive Plan of the City in order to be able to make the corresponding changes to the category and use of the DMU, making it less restrictive and more flexible.”

MODIFICATIONS OF USE AND SPACE

What the proposed amendment to the DMU District wants to achieve is mainly to increase its use. “As of now, the allowed zoning is only residential and commercial. What we are proposing is to expand it to include the use of offices and retail, together with the residential and commercial zoning that is allowed in our city.”

“The developer that wants to build in these parcels will have to choose between two of the uses, which should be compatible with the pattern of development in the area. In this way we will be increasing the commercial opportunities, promoting the development as of the needs of today and going hand in hand with the actual needs of our residents and visitors,” explains Perez.

One of the ideas behind this increase in the use of the land is to promote the pedestrian connectivity, the efficient use of the land and infrastructure and the recreational diversity. “This will assist us in growing with a better sense of planning and organization, achieving an integration with the already existing developments and modernizing our city.”

Julian Perez states that the city is also working on a modification to the Land Development Code, specifically to sections 68-557 and 68-664. “This modification will provide the ability for City Council to consider applications of developers that want to build their projects in parcels smaller than 10 acres, as long as they are within the DMU category.”

“What is happening now is that the area in between NW 58th street and NW 33rd street and NW 79th avenue and NW 87th avenue has very few 10 acres parcels and this is limiting the correct development of the area, so what we are looking for is the invigorate the area through the diversification of the construction and the usage of smaller spaces.”

In its current state, the code allows for construction in parcels of 10 acres and we are now proposing to allow construction in parcels smaller than 10 acres, but that should be equal or larger than five acres. This proposal has already been approved in first reading, but now it requires to go to a review process before the final decision is taken.

One of the main factors that needs to be taken into account during this review process is that the reduction of acres does not imply an increase in the density. Nevertheless, within this modification proposal there is no room for any change in the actual density allowed for the DMU category.

The authorized density for the parcels within the DMU is limited to no more than 25 units per gross acre and a maximum height of the building of eight floors. An additional density per gross acre could be authorized, up to 35 units and a height higher than eight floors for projects that exceed the minimum standard contained in section 86-83 of the City Code. There is also a bonus of up to 30% of the total number of units adjusted according to the Workforce Housing Density.

Regarding the future of the land located between the Southwest of NW 36th street with NW87th avenue, we need to take into consideration that there are developers that are interested in building that area, but for them as well as for any developer, they need to start an application process with the City of Doral, and even when these changes are not destined specifically to impact this parcel, it would still get the benefits of them when it takes place.

The proposal for the modification of the DMU has already been sent to the State Land Planning Agency in Tallahassee for its evaluation, therefore the City Council of the City of Doral should wait for its response before taking a decision about the changes to this zoning category.
“We are expecting the response from the State Land Planning Agency for the end of August of this year, for this reason we still have time until then to analyze the pros and cons of the proposal, to determine its effectiveness and feasibility and to answer to all the questions that the City Council might have regarding this item,” stated Perez.

ANALIZAN CAMBIO DE ZONIFICACION

PARA “DOWNTOWN MIXED USE”

Con el objetivo de proporcionar una mayor flexibilidad para combinar los usos comerciales y promover el desarrollo urbano eficiente de la zona dentro de la categoría “Downtown Mixed Use (DMU)” las autoridades de la Ciudad de Doral están analizando una modificación de zonificación de esta área.

Así lo informó el director de zonificación y planificación de la Ciudad Doral, Julián Pérez, quien explicó que los cambios propuestos pretenden adaptarse a las necesidades actuales de nuestra localidad y crear incentivos para que estos terrenos puedan desarrollarse de una forma más productiva y conveniente para todos.

Pérez se refiere específicamente a los terrenos localizados al sur de la 58 calle, al este de la 87 avenida, al norte la 33 calle y al oeste de la 79 avenida. “Lo que estamos analizando es hacer una enmienda al Plan Integral de la Ciudad para poder realizar los cambios de categoría y uso de la DMU, logrando que sea menos restrictiva y más flexible.

MODIFICACIONES DE USO Y ESPACIO

La enmienda propuesta para la categoría DMU pretende, principalmente, ampliar su uso. “En la actualidad, la zonificación permitida es residencia y comercial. Lo que se está proponiendo es expandir los usos a oficinas y venta al detal (retail), además de las permisologías residenciales y comerciales, vigentes en la actualidad”.

“La empresa que pretenda construir en estos terrenos tendría que escoger entre dos de estos usos que deben ser compatibles con el patrón de desarrollo adyacente. De esta forma, estaríamos ampliando las oportunidades comerciales, impulsando el desarrollo de una forma más actual y acorde con las necesidades de hoy en día de nuestros residentes y visitantes”, explica Pérez.

Una de las ideas que respalda esta ampliación del uso de la tierra es promover la conectividad peatonal, el uso eficiente de la tierra y de la infraestructura y la diversidad recreativa. “Esto nos ayudaría a crecer con mayor sentido de planificación y organización, logrando una integración con los desarrollos existentes y una modernización de nuestra ciudad”.          

Manifiesta Julián Pérez que también se plantea un cambio en el Código de Desarrollo de la Ciudad de Doral (Land Development Code, por su denomicación en inglés), específicamente en las secciones 68-557 y 68-664. “Esta modificación implicaría que el Ayuntamiento pudiese considerar aplicaciones de desarrolladores que aspiren a construir sus proyectos en parcelas menores de 10 acres, siempre que estén dentro de la categoría DMU.”

“Lo que sucede es que en esa área comprendida entre las calles 58 y 33 con las avenidas 79 y 87 ya quedan muy pocos terrenos de 10 acres y eso está limitando el adecuado desarrollo de esta zona, así que lo que estamos buscando es vigorizar la misma a través de la diversificación de la construcción y el uso de espacios más pequeños”.

Tal como le establece el código actual, la construcción en esta zona está permitida en lotes de 10 acres y ahora se propone que también sea permisada en parcelas menores de 10 acres, ( que deben ser igual o mayores a cinco acres).  Si bien esta propuesta ya fue aprobada en una primera lectura, ahora debe ir a un proceso de revisión hasta de que sea tomada la decisión final.

Uno de los principales factores a tomar en cuenta durante este proceso de revisión es que esta reducción de acres no implique un aumento de densidad. Sin embargo, en esta propuesta de modificación no está contemplada ningún cambio en la densidad actual permitida para la categoría DMU.

La densidad permisada para los terrenos dentro de DMU está limitada a no más de 25 unidades de vivienda por acre bruto y a una altura máxima del edificio de ocho pisos. Podría aprobarse una densidad adicional de hasta 35 unidades de vivienda por acre bruto y una altura superior a ocho pisos para proyectos que excedan los estándares mínimos contenidos en la sección 86-83 del Código de la Ciudad. Igualmente, establece una bonificación de hasta el 30% del total de unidades, ajustado al Workforce Housing Density, por su denominación en inglés.

Con respecto al futuro de la propiedad ubicada entre la parte suroeste de la 36 calle con la 87 avenida, hay que tomar en cuenta que existen desarrolladores interesados en construir en esa área, pero ellos, como cualquier otro constructor, deben iniciar un proceso de aplicación ante la Ciudad de Doral y si bien los cambios propuestos no están destinados específicamente para esta parcela, la misma podría verse beneficiada.

Esta propuesta de modificación a la categoría DMU ya fue enviada a la Agencia Estadal de Planificación Territorial de la Florida en Talahassee para ser evaluada, por lo que es necesario que esperar su respuesta antes de que el Concejo Municipal pueda tomar una decisión con respecto a este cambio de zonificación.

“La respuesta de la agencia estadal la estaríamos recibiendo para agosto de este año, por lo que tenemos hasta esa fecha para analizar los pros y los contras de esta propuesta, determinar su efectividad y factibilidad y responder las dudas que los miembros del Concejo Municipal tengan con respecto a este tema”, señaló Pérez.
