Summary of Council Zoning Meeting – September 17, 2014

The Council Zoning Meeting took place September 17 at 6 pm at the City Hall. After the call order, the Pledge of Allegiance and the invocation, the order of Businesses in the agenda was discussed. Two of the item were deferred: The ordinance # 2014-24 to approve the rezoning of 30+ acres located east of NW 107 and south of NW 87th Terrace from Traditional Neighborhood Development (TND) to the Midtown Doral Planned Unit Development (PUD). The second item deferred was the Grand Bay North final Plat, a resolution to approve the final plat for the Grand Bay North Planned Unit Development located West of NW 102 Av. and South of NW 90 Street.

IMG_8302 copyNext up in the agenda was a discussion proposed by Councilwoman Beatriz Rodriguez Aguilera to take measures to improved traffic conditions through the approval of an ongoing Coordinated Traffic Study which main goal is to identify practical solutions to minimize the impact the traffic causes by current construction projects; and also to bring all Doral’s traffic updated and information to one accessible user-friendly webpage including GIS Mapping. Motion was approved.

An ordinance was approved to allow a plan modification at the Doral Site Plan, a variance in height from section 68.507 (3) (1) of the Land Development Code to permit a height of 81.6 feet.

An ordinance providing Property Maintenance Standards was discussed in order to protect and improved the health, safety and welfare of the citizens of the City of Doral.

Requested by Councilwoman Ana Maria Rodriguez an ordinance to amend the article VI wich refers to the “Off-Premises Billboard Signs”, in Chapter 80 amending the location of the signs was also discussed.

Since there seems to be a competitive edge between the parties involved and since the City has an agreement with the parties, after a heated discussion the City Attorney suggested to the Council to bring the settlement before making any decision. Councilwomen Fraga also suggested to deferred it since part of the documentation in order to evaluate it has been brought to them an hour before the meeting. Even though the discussion, the ordinance passed.

Another highlight of the evening was the rezoning of three City Parks totaling 27.6 acres and to modify the future land use map from moderate density residential and low density residential to Public Park and Recreation.

On Feb 11, 2008 the City Council approved the City of Doral Green Master Plan. A “Green Ordinance” has been approved to amend the existing code and to insert new sections requiring the green building development practices such as renewable energy devices, walk able and healthy streets, and energy efficient outdoors lighting for commercial buildings.

During the evening, the Final Plat for Doral Common Residential and Commercial Planned Unit Development was approved as well as a resolution approving a site plan modification for the Cosmopolitan Hotels (formerly known as Las Placetas site plan). The report presented by the staff proposed the approval of the site modification subject to some conditions but the report stated that overall, the proposed site plan is consistent with the proposed future land use and it will be compatible with the neighborhood.

Another highlight was the approval of the rezoning of the property located on NW 33rd Street and NW 91st Av. from Industrial Commercial (IC) to Multifamily Residential (MF-1) as well as a resolution to approve the variance from section 68-168 (1) (F) of the land development code to allow 12 feet from yard setback in lieu of the minimum 15 feet, a variance to permit an 8 feet rear setback in lieu of the 10 feet minimum.

Doral Community Coalition spoke regarding both Contempo and Transal Park Residences saying that amending and changing from Industrial to Residential zone will have an impact on the life of residents and it cannot be done on a case by case basis without considering the City’s Comprehensive Development Master Plan. The representative of the Doral Community Coalition also said that a carefully evaluation of the Master Plan must be made before taking any decision.

 

Transal Park Residences Future Land Use

After a heated discussion among all the parties involved and residents the ordinance # 2014-16 which modifies the City’s Comprehensive Development Master Plan to change the land designation from Industrial (I) to High Density Residential (HDR) of 16.41 acres for the properties on the southeast corner of NW 87th and NW 27 Street and from Industrial Commercial (IC) to Planned United Development (PUD), didn’t pass.

Many agencies, mostly state agencies had presented their feedback regarding the impact that the change could have on the City of Doral.

As stated in the report presented by the staff to the Council Members, which included a through explanation of the feedback received by the State Agencies and also a chronological history as why this area has been an industrial zone since the ‘50s: “The Viaduct project will generate significant truck traffic within close proximity of the project area that could result in an increase noise pollution and an unduly direct and/or indirect negative impact on the area’s air quality standard. These impacts will eventually infringe on the new residents quality of life, long-term aesthetic value of the residential area, and will impede the proposed multi-family residential development from becoming a typical safe residential community with safe routes for children to walk to school; and development of a comprehensive network of new or enhance greenways of walking trails”.

Since the latter failed to pass, the City Attorney said that it would be inconsistent to discuss and vote the next two items in the agenda regarding the rezoning of the area.

Resumen de la Reunión del Consejo de Zonificación.

La Reunión de Zonificación del Consejo se llevo a cabo el miércoles, Septiembre 17 a las 6 pm en el City Hall. Después de la orden de convocatoria, el Juramento a la Bandera y la invocación, se discutió el orden de los temas en el orden del día.

El primer tema en el orden del día fue una discusión propuesta por la concejal Beatriz Rodríguez Aguilera para tomar medidas y así mejorar las condiciones de tráfico a través de la aprobación de un Estudio de Tráfico Coordinado cuyo objetivo principal es identificar soluciones prácticas para reducir al mínimo el impacto en el tráfico por los proyectos de construcción actuales; y también para traer toda la información referida al tráfico de Doral actualizada en una página web fácil de usar y accesible, incluyendo mapeo GIS. La propuesta fue aprobada.

Se discutió además, una ordenanza que proporciona estándares para el Mantenimiento de Propiedades con el fin de proteger y mejorar la salud, la seguridad y el bienestar de los ciudadanos de la Ciudad de Doral.

Solicitada por la Concejal Ana María Rodríguez, fue discutida una ordenanza para modificar el artículo VI el cual se refiere a las locaciones de los carteles publiciatrios, en el capítulo 80 el cual modifica la distancia de los carteles.

Puesto que parece haber una disputa competitiva entre las partes implicadas y desde la Ciudad tiene un acuerdo con las partes, después de una larga discusión el abogado de la ciudad sugirió al Consejo que revise el acuerdo que tiene con las partes antes de tomar cualquier decisión (para no beneficiar ni a uno ni otro). La Concejal Fraga también sugirió diferir el tema ya que parte de la documentación con el fin de evaluar fue enviada a ella una hora antes de la reunión. A pesar de la discusión, la ordenanza aprobada.

Otro punto culminante de la noche fue la rezonificación de tres parques de la ciudad por un total de 27,6 hectáreas para modificar el futuro mapa de uso del suelo de densidad moderada residencial y densidad residencial baja a Parque Público y Recreación.

El 11 de febrero de 2008, el Concejo Municipal aprobó el Master Plan Verde de la Ciudad de Doral. La “Ordenanza” Verde ha sido aprobado para modificar el código existente e insertar nuevas secciones que requiere prácticas de desarrollo de edificios verdes, como los dispositivos de energía renovable, con calles peatonales y saludables y e iluminación al aire libre para edificios comerciales con energía eficiente.

Durante la noche, el Plat Final de Doral Residencial y Comercial Común de la Unidad de Desarrollo Planificado fue aprobado, así como una resolución para aprobar una modificación de plan de sitio para los Hoteles Cosmopolitan. El informe presentado por el personal, propuso la aprobación de la modificación del sitio sujeto a algunas condiciones, pero el informe indica que en general, el plan de sitio propuesto es consistente con el uso de la tierra y será compatible con el vecindario.

Otro punto a destacar fue la aprobación de la nueva zonificación de la propiedad ubicada en NW 33rd Street y NW 91a Av. de Comercial Industrial (IC) a Multifamiliar Residencial (MF-1), así como una resolución para aprobar la varianza de la sección 68-168 (1) (F) del código de desarrollo de la tierra para permitir 12 metros de patio en lugar de la un mínimo de 15 pies, una varianza para permitir un 8 pies en lugar del mínimo de 10 pies en la parte de atras.

El representate de Doral Community Coalition habló bastante sobre Contempo y Transal Park Residences y dijo que si se modifica el area y cambia de Industrial a Residencial tendrá un impacto en la vida de los residentes y que no se puede realizar caso por caso sin tener en cuenta el Plan Maestro de Desarrollo Integral de la Ciudad. El representante de la Coalición de la Comunidad Doral también dijo que una evaluación cuidadosa del Plan Maestro se debe hacer antes de tomar cualquier decisión.

 

Transal Park Residences, Uso Futuro de Tierras

Después de una acalorada discusión entre todas las partes involucradas y los residentes de la ordenanza #2014-16 la cual intenta modificar el Plan Maestro de Desarrollo Integral de la Ciudad para cambiar la designación de la tierra Industrial (I) a Residencial de Alta Densidad (HDR) de 16.41 acres de las propiedades en la esquina sureste de la NW 87 y NW 27 Street de Comercial Industrial (IC) a Unidas de Desarrollo Planificada (PUD), la ordenanza no fue aprobada.

Muchos organismos, en su mayoría agencias estatales habían presentado sus opiniones sobre el impacto que el cambio podría tener en la Ciudad de Doral.

Como se afirma en el informe presentado por el personal a los miembros del Consejo, el incluye una explicación de la opinión recibida por los organismos del Estado y también una historia cronológica explicando las razones de por qué esta zona ha sido una zona industrial desde los años 50: “El proyecto de viaducto generar tráfico de camiones significativa en las cercanías de la zona del proyecto que podría resultar en un aumento de la contaminación de ruido y un indebidamente directa y / o impacto negativo indirecto sobre la norma de calidad del aire de la zona. Estos impactos eventualmente infringir la nueva calidad de vida de los residentes, valor estético a largo plazo de la zona residencial, y se impedirá el multifamiliar desarrollo residencial propuesto se convierta en una comunidad residencial segura típico con rutas seguras para que los niños caminen a la escuela; y el desarrollo de una amplia red de nuevo o mejorar las vías verdes de senderos para caminar “.

Puesto que esta último ordenanza no fue aprobada, el abogado de la ciudad dijo que no sería coherente discutir y votar los próximos dos temas en el programa con respecto a la rezonificación de la misma zona.
